CBP has updated its guidance on in-transit exceptions for IEEPA Reciprocal Tariffs as originally outlined in CSMS #64680374. This revision extends the in-transit end date from May 28, 2025, to June 16, 2025, due to further consideration of the realistic timeframes for goods to be in-transit prior to the load and in-transit dates of April 5, 2025; April 9, 2025; and April 10, 2025. This updated guidance applies temporarily while the stay of the U.S. Court of International Trade judgment remains in effect.
Goods reported under heading 9903.01.28 must be in-transit prior to 12:01 a.m. EDT on April 5, 2025, and entered for consumption, or withdrawn from warehouse for consumption, between 12:01 a.m. EDT on April 5, 2025, and before 12:01 a.m. EDT on June 16, 2025. For products subject to additional country-specific rates (9903.01.43–9903.01.76), if they were in-transit between April 5 and April 9, 2025, and entered before June 16, 2025, they are subject to a 10% additional rate under 9903.01.25. Similarly, Chinese-origin articles listed under 9903.01.63 that were in-transit between April 9 and April 10, 2025, and entered before June 16, 2025, are also subject to the 10% additional rate and must be reported under 9903.01.25.
