On December 17, 2025, the Office of the U.S. Trade Representative (USTR) published a notice implementing tariff modifications for goods from Switzerland and Liechtenstein, effective retroactively to 12:01 a.m. EST on November 14, 2025. This action follows the November 14, 2025 announcement by the United States, Switzerland, and Liechtenstein of a Framework to negotiate an Agreement on Fair, Balanced, and Reciprocal Trade.
Under this agreement, the United States intends to apply the higher of either the U.S. most-favored-nation (MFN) tariff rate or a total tariff rate of 15%, comprised of the MFN tariff and a reciprocal tariff, on products of Switzerland or Liechtenstein. Consistent with Executive Order 14346, the applicable additional ad valorem duty will be determined based on the article’s Column 1 General rate of duty under the HTSUS. For articles with a Column 1 duty rate below 15%, an additional duty will apply so that the total rate equals 15%. For articles with a Column 1 duty rate of 15% or higher, no additional ad valorem duty will apply.
The notice further provides that certain products of Switzerland and Liechtenstein identified in the Potential Tariff Adjustments for Aligned Partners and listed in Annex I to the notice are exempt from the reciprocal tariff imposed under Executive Order 14257, as amended. These exemptions include certain agricultural goods, unavailable natural resources, aircraft and aircraft parts, and generic pharmaceuticals and their ingredients and chemical precursors. The HTSUS is modified accordingly, as set out in Annex II, for goods entered for consumption or withdrawn from warehouse for consumption on or after November 14, 2025.
The USTR also confirmed that, to the extent the retroactive implementation of the notice requires a refund of duties collected, such refunds will be processed pursuant to applicable law and CBP’s standard refund procedures. The United States agreed to these tariff modifications with the understanding and expectation that the Agreement would be successfully negotiated by the first quarter of 2026. If the Agreement is not concluded by March 31, 2026, the United States will review and reconsider the tariff modifications, as appropriate. The USTR and Department of the Treasury will continue to monitor conditions underlying the national emergency declared in Executive Order 14257, and the annexes to the notice may be amended as necessary.
