Extension of Section 301 China Product Exclusions

The Office of the U.S. Trade Representative has announced a further extension of the current Section 301 exclusions through November 29, 2025.

As background, on September 18, 2024, the Office of the USTR announced fourteen exclusions covering certain solar manufacturing equipment. These exclusions were initially effective from January 1, 2024, through May 31, 2025. On May 31, 2025, USTR extended both the 164 exclusions continued in May 2024 and the fourteen exclusions granted in September 2024, for a total of 178 exclusions. That extension was set to run through August 31, 2025.

Following continued consideration of public comments, input from advisory committees, and the advice of the interagency Section 301 Committee, the Office of the USTR has now determined that an additional 90-day extension is appropriate. Accordingly, the 178 exclusions identified in the June 5, 2025 notice are extended through November 29, 2025, pursuant to section 307(a)(1)(C) of the Trade Act of 1974, as amended.

The extension covers all exclusions under heading 9903.88.69 and U.S. notes 20(vvv)(i) through 20(vvv)(iv) to subchapter III of chapter 99 of the HTSUS. It also applies to all exclusions under heading 9903.88.70 and U.S. note 20(www) to subchapter III of chapter 99 of the HTSUS. The extension is effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. EST on September 1, 2025, and before 11:59 p.m. EDT on November 29, 2025.
