On January 29, 2026, President Trump issued an executive order under IEEPA, citing national security risks. Under this order, it was authorized that additional ad valorem duties may be imposed on U.S. imports that are products of countries determined to directly or indirectly sell or otherwise provide oil, including crude oil and petroleum products, to Cuba. This order is effective at 12:01 a.m. EST on January 30, 2026.
The Executive Order does not specify the exact tariff rates. However, it authorizes the Secretaries of Commerce and State to take all necessary actions, including issuing rules, regulations, and guidance, to implement the tariff system and related measures. The Secretary of Commerce, in consultation with the Secretary of State, will determine whether a foreign country has provided oil to Cuba, including through intermediaries. If an affirmative finding is made, the Secretary of State, in consultation with the Secretaries of the Treasury, Commerce, and Homeland Security and the U.S. Trade Representative, will recommend whether additional tariffs should be imposed and at what rate. The President will make the final determination.
The President retains broad authority to modify the Order in response to changed circumstances, including retaliation by affected countries or meaningful actions by Cuba or other impacted countries to address U.S. national security and foreign policy concerns. The Secretary of Commerce will continue to monitor whether foreign countries provide oil to Cuba, while the Secretary of State will monitor the national emergency and may recommend additional action if current measures are deemed insufficient. The Secretary of State is also directed to provide recurring and final reports to Congress on actions taken under the Order.
