EPA Extends Deadline for PFAS Reporting Requirement

The EPA has issued an interim final rule extending the deadline for submitting the one-time PFAS report required under the Toxic Substances Control Act. The start of the submission period has been delayed by nine months, from July 11, 2025, to April 13, 2026.

 

Under this rule, domestic manufacturers and importers of per- and polyfluoroalkyl substances (PFAS), often referred to as “forever chemicals,” who manufactured or imported PFAS or PFAS-containing products at any time from 2011 through 2022, are required to report information to the EPA. Required data includes PFAS uses, production volumes, byproducts, disposal practices, exposures, and any known environmental or health effects, among other criteria. The requirement applies not only to traditional chemical manufacturers but also to importers of articles (products) that may contain PFAS.

 

The EPA originally issued the rule on October 11, 2023, and cited the need for additional time to finalize the data collection platform and supporting software as the reason for the deadline extension.

 

Revised Deadlines:

  • October 13, 2026: Reporting submission deadline for most manufacturers and importers

  • April 13, 2027: Extended deadline for small manufacturers reporting exclusively as article importer
