The Commerce Department’s Bureau of Industry and Security (BIS) has announced the opening of the September 2025 inclusions window for derivative steel and aluminum articles submissions under Section 232 of the Trade Expansion Act of 1962. As outlined in a Federal Register notice published on September 15, 2025, the window opened the same day and will close at 11:59 p.m. EST on September 29, 2025.
On February 10, 2025, the President issued Proclamations 10895, Adjusting Imports of Aluminum into the United States, and 10896, Adjusting Imports of Steel into the United States. These proclamations imposed duties on specified imports of aluminum, steel, and certain derivative articles, and directed the Secretary of Commerce to establish a process for considering additional derivative products.
In response, BIS published an interim final rule (IFR) on May 2, 2025 (90 FR 18780), amending Supplement No. 1 to Part 705 of Title 15 of the Code of Federal Regulations. The IFR created a recurring process that provides two-week submission windows each January, May, and September for requests to include additional derivative aluminum and steel articles within the scope of Section 232 duties.
For the current September 2025 window, only submissions for inclusion requests are being accepted and must be emailed to the Defense Industrial Base Programs inbox at [email protected].
Once the submission period closes, accepted requests will be posted for a two-week public comment period on Regulations.gov under Docket ID BIS-2025-0023.
