On August 6, 2025, President Trump issued an Executive Order under the authority of the IEEPA to impose an additional 25% tariff on imports from India. This action was taken in response to India’s importation of Russian oil and oil products. It is important to note that this tariff is separate from the IEEPA reciprocal tariff announced last week and constitutes an independent measure.
Effective 12:01 EST on August 27, 2025, all goods from India will be subject to the additional 25% IEEPA Russian Oil tariff in addition to the general rate of duty, any applicable antidumping or countervailing duty, any section 201 duty if applicable, the IEEPA reciprocal duty of 25 percent, and any other duties, fees, taxes or charges.
The additional 25% IEEPA Russian Oil tariff will not apply to goods currently subject to Section 232 duties, which presently include steel, aluminum, autos, auto parts, and copper, or to any goods subject to future Section 232 actions. It will also not apply to articles listed in Annex II of Executive Order 14257, issued April 2, 2025, which relates to the original reciprocal tariff order. Additional exemptions include goods for personal use, donations of food, clothing, and medicine intended for humanitarian relief, and informational materials.
Goods that are loaded onto a vessel at the port of loading and are in transit on the final mode of transit before 12:01 a.m. EDT on August 27, 2025, and are entered for consumption or withdrawn from warehouse for consumption before 12:01 a.m. EDT on September 17, 2025, will not be subject to the additional 25% tariff.
Except for articles eligible for admission under domestic status, articles subject to this additional tariff that are admitted into a foreign trade zone on or after 12:01 a.m. EST on August 27, 2025, must be admitted as privileged foreign status.
The order does not address duty drawback or clarify whether such claims will be permitted or prohibited.
If a foreign country retaliates against U.S. goods as a result of these tariffs, the President may increase or expand the scope of the tariffs. Should Russia or another affected country take significant steps to address the national emergency described in this order and align sufficiently with the United States on national security, foreign policy, and economic matters, the President may further modify this order.
