On February 6, 2026, President Trump signed an Executive Order imposing an additional ad valorem duty on imports of articles that are products of foreign countries that directly or indirectly purchase, import, or otherwise acquire goods or services from Iran. The action is based on a determination that the Government of Iran’s actions and policies pose concerns to U.S. national security, foreign policy, and economic interests, resulting in the declaration of a national emergency.
According to the White House, the additional tariff may be imposed at any time after 12:01 a.m. EST on February 7, 2026. The duty rate will be recommended by the Secretary of State, in consultation with the Secretaries of the Treasury, Commerce, and Homeland Security, as well as the Office of the U.S. Trade Representative. The President will have discretion to set the final tariff amount, which the order notes could be, for example, 25%.
The Executive Order also provides that if a foreign nation retaliates against the United States in response to the additional duty, the President may increase the tariff or take other actions to ensure the effectiveness of the order and address the national emergency posed by Iran. Conversely, if the Government of Iran or an affected foreign country takes significant steps to address the national emergency and aligns sufficiently with the United States on national security, foreign policy, and economic matters, the President may modify the order.
